Agree the deliverable

The instruction may cover a specified PRC-law question, document review, transaction support or assessment of a China-side procedure. Legal analysis identifies the relevant facts, assumptions, open questions and any work requiring separate expertise.

Formal opinions, third-party reliance and use in proceedings require an express scope.

Set the working arrangements

Confirm the instructing party and client, conflicts, authority to share information, communication with the ultimate client, timetable and fee. Each engagement identifies the responsibilities of the participating advisers.

How we work with overseas counsel

We can handle an agreed part of the China work while you coordinate the wider matter. Before we begin, we will agree who instructs us, who the client is and how the advisers will communicate.

  1. Send a short brief

    Tell us your role, the China-law question, the work you need and any deadline. Start with a non-confidential summary. We will explain what party details are needed for the conflict check before you share sensitive documents.

  2. Confirm that we can act

    We check conflicts and confirm the client, the instructing party and the responsible lawyer. We also agree who may share documents, receive our advice and communicate with the ultimate client.

  3. Agree the scope and fee

    The proposal identifies the questions, document set, deliverable, language, timetable and fee. It also states who will pay and whether external specialists or costs are needed. Formal opinions, third-party reliance and use in proceedings require express agreement.

  4. Carry out the China work

    We review the agreed materials, identify missing facts and keep you informed at the agreed intervals. We raise changes in scope, urgent issues and work requiring separate expertise before proceeding beyond the instruction.

  5. Review the advice and hand over

    You receive the agreed written advice, document or procedural assessment. We explain the assumptions, outstanding questions and next steps, and address the feedback included in the engagement. Further work is agreed separately.
